Thank you for taking an interest in my work! This is my Terms of Service which states the guidelines for the usage of my artwork and how I run my business. It also includes my commission prices/examples. I ask that you read these terms all the way through before requesting a commission. (Please note that they are subject to change as I encounter new situations that need to be addressed.) By buying my work, you are agreeing to these terms regardless of if you have read them fully or not. If you have any questions or concerns about anything at all, please feel free to bring them to my attention and I will do my best to resolve them!

General Rules

What Can & Cannot Be Done with My Artwork:

As the artist, I own all the rights to my works and can use them in any way including posting, using them as promotional content for my business, using them as commission examples, etc. However, I will not use a commission piece for any purpose that a client requests me not to.

You, as the client, are allowed to…

Upload the art to any social media. This is also allowed for anyone who owns the character(s) portrayed even if they were not the original client. I must be credited as the creator.
Give the art to the person a character design is being sold to.
Use the art for personal uses such as re-printing, profile pictures, etc.

You are not allowed to…

Claim any of my works (including drawings, written pieces, photographs, and physical products) as your own. You are also not allowed to trace, heavily reference, modify, recolor, repost without credit, or remove the watermark from any of my works. If my work is used in any of these ways, I will ask that the behavior is stopped and for all posts of the stolen works to be removed. Failure to comply, will result in being blacklisted. I will try to be as fair as possible in these situations, but it is ultimately up to my discretion.
Use my work for any commercial use, including but not limited to reselling, using it as a design on a product, making prints of it, or using it as promotional content. The only exception to this rule is if explicit written permission is given from me.

What Happens if These Rules Aren’t Followed:

Any situation regarding scam, theft, or other inappropriate behavior will not be tolerated. Scam or theft will result in an instant blacklisting and other behaviors will be subject to a 3 strikes penalty system. These behaviors include:

Displaying very prominent behavior relating to homophobia, racism, pedophilia, etc
Displaying aggressive or toxic behaviors such as name calling, yelling, bullying, stalking, etc
Stirring up drama with intentions to defame someone, gain attention, etc
Backing out of/not completing a bid, offer, or commission purchase
Breaking any of the terms outlined in this document

Strike 1 = a warning.

Strike 2 = being banned for two weeks from purchasing works from me.

Strike 3 = being blacklisted (permanently banned from purchasing works from me).

Payment:

I only accept money through PayPal (US Dollars). I also only accept money via an invoice I send to the client. Any payment sent in another form will be declined and returned. I ask that the client has the payment ready as I will only begin working after receiving it. If the invoice is not paid within 48 hours, I will not continue to prioritize the commission request. I am not responsible for any charges made to someone’s account if the client chose to use a PayPal account that does not belong to them.

- These can be done either traditionally with any fullbody pose or digitally using another artist’s base. They will include up to 3 accessories/items, a basic bio, and a close-up headshot for free; anything else will cost extra. I will need as much info about the design you are looking for including but not limited to: moodboards/pictures that represent the aesthetic, colors, gender, species, etc.

I have the right to decline any commission for any reason without an explanation or refund. The most likely scenarios for this happening would be if the client is a scammer/thief, the client is being disrespectful/aggressive, or the client is making me uncomfortable.

I will do NSFW artwork but only if the client is 18+ and shows me proof in the form of a state ID. This is done solely to protect myself as it is illegal to sell pornographic content to minors. Do not attempt to change my mind because the answer will always be no!
All commission requests will be taken through a Google form which I will send when a commission is requested. This makes it easier for me to organize every submission. When filling out the form, be as detailed as possible. I will need the client to include the character’s reference sheet, color/pose/expression preferences, information about the character, and anything else that I may need to know to ensure the client gets the product they are wanting. This helps me determine an accurate price as well as avoid making mistakes. If the client is looking for the commission to be completed by a certain deadline, this also needs to be stated before the payment is sent. I will not always work with deadlines, so I need to be informed beforehand.
The client must be able to provide me with a complete and clear reference sheet of the character(s) they want drawn. I prefer the reference to be digital, but I will also work with traditional ones. I will not work with an unclear picture or a description alone. Keep in mind that when working with traditional mediums, I cannot color pick like with digital art. I will do my best to match the character's colors with the supplies I have. It is not my fault if errors occur due to the reference sheet being outdated or unspecific. The client will need to notify me of any necessary details about their character’s design, especially if the design has been modified.
The commission should be completed within 2-3 months and I will work on commissions in the order that I receive them. Please keep in mind that I am an adult whose life does not revolve solely around commission work. There are other responsibilities and life things that may delay commission progress. I ask that clients try to be patient with me if that is the case. I will do my best to update all clients if anything like that were to pop up. Also, commissions do take priority over other owed art such as trades or offers. There may even be times when I need to take the time to step away from commissions to work on personal pieces and I ask that clients respect that as well.
Schedule:
- Monday - Friday = Workdays
- Saturday & Sunday = Days off
I will give updates on the progress of the commission at each stage of the process (sketch > lineart > colored > mailed). Work will not be continued on a commission until I receive approval of each stage. The client can also request an update whenever they like, as long as they are not spamming me. I will put a commission on hold if I need to clarify something with the client; I will not begin working until after I get the response and I may work on other commissions from my queue in the meantime.
I ask that clients correct me if I make any mistakes in the process of drawing or coloring their character. I will gladly try to fix them. In the case of extreme/unfixable mistakes on my part, I will restart the commission with no extra cost. Line edits can only be made during the sketch stage and color/design edits can only be made before I start coloring. If edits are requested late or after a stage is completed, there may be an extra charge, or the edit will be denied. For YCHs, certain edits may be unavailable or come with an extra charge.

I will offer refunds on a case-by-case basis and at my own discretion. Generally, refunds will not be given without good reason. In the event of a refund, the client will receive a full refund if the artwork is not started/only a sketch, 50% if it is lined/colored, and none if completed. A full refund may also be issued if the commission has not been started in 30 days since the date of purchase; this is also on a case-by-case basis and is determined by queue placement or the client being informed of a wait prior to buying. Filing a chargeback without talking to me and being offered a refund will result in you losing all rights to the artwork. If I have terminated business with a client due to inappropriate behavior or blacklisting them, a refund will not be issued.
Traditional art will be laminated and shipped without extra cost to any clients inside the US. For any international clients, lamination will still be included free of cost, but shipping will have an extra charge of $5. Digital art will be emailed to the client.
If the client has a traditional commission that needs to be shipped, they will need to get in contact with me after it is completed. I will need the following information: their full name (first and last) and their address. International clients will need to write out their address for me exactly as it would be written on the envelope. I am NOT responsible for late, lost, or damaged art once it is in the mail. There will be no replacements or refunds for problems caused by the mail carrier.

Adopts/Character Designs:

When a client buys an adopt from me, they get full rights to the design except the right to claim they have created it. If they redesign the adopt, they still need to credit the original design to me (or the original creator in the case that it wasn’t designed by me).
Any of the characters/designs I own are off limits. They are not to be claimed, sold, replicated, “bred” (mixing their design with another character to make a “child” design), etc by anyone else without explicit permission from me.

Other Designs:

These include any designs I create for tattoos, posters, logos, clothing, etc. They are not to be stolen, copied, or resold.

Trades

I have the right to decline any trades.
Commissions have priority over trades/other owed art and will be worked on first.
The other half should be equal in amount and effort as mine. If I mail my part of the trade, the other half should mail be too unless agreed otherwise.
I will give updates on the progress of the art (sketch > lineart > colored > mailed). Updates can also be requested at any time if I am not being spammed.
The art will be laminated and shipped without cost or emailed.

Blacklist

This is a list of anyone who has received 3 strikes from me for inappropriate behaviors or has scammed/stolen from me. They are not allowed to purchase or own any of my works. If a third party tries to purchase something from me with the intention of giving it to the blacklisted individual, they will also be blacklisted. If a blacklisted individual receives a work of mine unintentionally from a third party who was unaware of the blacklisted status, this will not result in penalty for the third party.
